Personally Identifiable Information:

Device data, including internet protocol (IP) address, operating system, device type and version, browser type and version, browser id, the URL entered, the referring page, date/time of visit, other user agent string data, the time spent on our Service, hardware type, the version of your operating system, and your in-game activity, and any errors that may occur during the visit to our Services. Device data may overlap with the other categories of data listed below. We and our service providers may use this information to provide you with personalized advertising and other content, including advertising and content based on your location.

Analytics/Usage data, including the path taken to our Service, through our Service, and when exiting our Service, usage and activity on or in connection with our Service (e.g., pages visited, links clicked, videos watched), metrics on how many emails we send are actually opened and which attachments or links are opened, clicked, or viewed (such as via pixels, as described further below). We may also use third-party tools to collect information you provide to us or information about how you use the Service, including mouse movements, scrolling, clicks, and keystroke activity on the Service and other browsing, search, or purchasing behavior. Location data, including geographic location we or our third-party providers may collect, such as via permissions within the App operating system or browser functionality. We and our service providers may use this information to provide you with personalized advertising and other content, including advertising and content based on your location.

Advertising/Advertising measurement data, including data associated with your view of, or your clicks on, advertisements served on our Service, response to the marketing activities carried out by us (e.g. marketing campaigns, competitions, offers, etc) such as information about when you open your email communications, cookie IDs or other digital or proprietary identifiers (e.g., iOS IDFA, Google AAID, emails or phone numbers) assigned to or sent by such device or user, and device metadata, analytics/usage data, and location data described above, in each case, for purposes of serving advertising (personalized or otherwise) or facilitating advertising measurement/attribution to better optimize or otherwise understand the effectiveness of ad campaigns.

Business Partners

We may receive your information from our business partners, such as companies that develop games that we publish, companies that offer their products or services on our Service or marketing/advertising and analytics partners, including third-party brands/agencies or other partners that facilitate the buying and selling of advertising inventory on our Service, measure of the effectiveness of those related ad campaigns, or inform business analytics (e.g., view rates, bounce rates, audience composition).

 

Social Networking Sites:

If you access a Muffingames, Inc. Service via a third-party social networking site (a "Social Game"), Muffingames, Inc. may receive information about your social networking site profile and other information shared by the third party, including your social networking site user ID, first and last name, profile and cover photos, and e-mail address provided to the Social Game. If you invite new members into your Social Games network or send messages through Social Games, we may collect the information associated with those messages, including your friends' social networking site user IDs, email addresses and content. We use this information to allow you to log into your account, to communicate or interact with individuals on the social network, to better understand the demographics of our visitors, and to personalize content and advertising. Individuals should always review and, if necessary, adjust their privacy settings on third-party websites and social media networks and services before sharing information or linking or connecting them to other services.

 

Information We Receive From Authentication Service

Some parts of our Service may allow you to login through a third-party social network or authentication service such as Facebook or Google. These services will authenticate the individual’s identity and provide the option to share certain personal information with us, which could include a name, email address, address book and contacts, or other information. The data we receive is dependent on that third party’s policies and the individual’s privacy settings on that third-party digital property. We use this information to authenticate the individual’s account, to provide our Services, to communicate with our users, and for advertising and marketing purposes.

 

Service Providers

Our service providers that perform services on our behalf, such as payment processors or survey and third parties who conduct marketing/advertising and analytics activities on our behalf, collect personal information and may share some or all of this information with us.

HOW WE USE AND SECURE COLLECTED INFORMATION


Muffingames, Inc. collects, stores, and uses information for various purposes including providing improved gaming experience. We may use your username, email address, and password to uniquely identify you as a user on a Muffingames, Inc. Service, to provide you with services and to process transactions. We may use or display your username and icon or profile photo, if applicable, for the purposes of rankings, competitions or sweepstakes, chat identification, and/or game high scores. We may also use or display your username and icon or profile photo for marketing purpose or press releases. Your username, profile, and icon or profile photo may also be displayed in any Muffingames, Inc. Service. We may use your date of birth to confirm your eligibility to participate in Muffingames, Inc. Services.

Subject to the terms of this Privacy Policy, we may use your contact information to process our promotional newsletters and/or email campaigns and to send you updates, security alerts, or administrative messages relating to Muffingames, Inc. Services. Your contact information will allow us to notify you about new features, enhancements, or resolution of Muffingames, Inc. Services problems, to handle and/or route your customer support questions and issues, and inform you of upgrade opportunities, sweepstakes, contests, prizes, and/or special events.

If our "Tell a friend" feature is available within a particular Muffingames, Inc. Service, and you choose to participate in it, your email will be shared with the person to whom you send the Muffingames, Inc. Service using this feature. We may use an IP address to surface the appropriate country-based version of a Muffingames, Inc. Service to a user or to exercise our ability to restrict access to the site by users who have violated our Terms of Use.

We and our third-party partners use your information to enhance your experience with Muffingames, Inc. Services. This information enables us and our third-party partners to run our affiliate programs and provide you with customized content or offerings, such as personalized Muffingames, Inc. advertisements on other websites and mobile applications and personalized third-party advertisements within certain Muffingames, Inc. We may use information collected to calculate aggregate, anonymized statistics about our user community for the purpose of enhancing our Muffingames, Inc. Services or for security purposes.

If you access a Social Game, we may use your social networking site profile ID to link your social networking site account with your activities within the Social Game or offer personalized Muffingames, Inc. advertisements on the social networking site. We may use your social networking site first, last and user names and icon to identify you to the social networking site account you've linked to your activities within the Social Game, as well as for the purposes of rankings, competitions, sweepstakes, game high scores and/or identification to your social network.

If you access a Social Game and provide us with another person's contact information for purposes of delivering information through a Social Game, we may use this information to contact, and if necessary, remind that person that he or she has been invited to join a Social Game, or received content through a Social Game. All invitees are provided with the option not to receive further invitations from Muffingames, Inc..

We may use your information to understand our users and to tailor or optimize the Muffingames, Inc. Services. For example, we may analyze statistics and trends to make the Muffingames, Inc. Services better and to develop or better personalize the Service or new services or features.

We may use your information to protect our company, our affiliates, and the Muffingames, Inc. Services.  We may also use information in order to comply with laws, regulations, court orders, or other legal obligations or to assist in an investigation, protect and defend our rights and property, or the rights or safety of third parties, enforce our Terms of Use, this Privacy Policy, or agreements with third parties, detect and prevent fraud or for crime-prevention purposes, or for any other reason permitted by law. 

We may use your personal information for any other purposes at your direction or where notice is otherwise provided.

We at Muffingames, Inc. take reasonable measures to help protect the information we collect from loss, theft, misuse and unauthorized access, disclosure, alteration, and destruction.

SHARING INFORMATION

 

In addition to the disclosures contemplated elsewhere in this Privacy Policy, we may disclose customer information as described below. We require that the parties whom we disclose customer information as described below agree to process such information in compliance with our Privacy Policy contained herein, and we will use reasonable efforts to limit their use of such information and to use other appropriate confidentiality and security measures.

Third-Party Partners:

We may disclose your personal information as well as aggregate, anonymous information to third-party business partners such as game developers of games we publish, marketplaces, and third parties who perform services for and on our behalf, such as developing games that we publish, payment processing, prize fulfillment, delivering packages, sending postal mail, collecting and analyzing data, optimizing gameplay, providing search results and links (including paid listings and links), and providing advertising and marketing assistance, including serving ads on our behalf on third-party websites and mobile applications and serving ads on behalf of third parties within certain Muffingames, Inc. Services. Third parties also may use anonymized or aggregated customer information to improve and enhance their services.

Business Transfers:

As Muffingames, Inc. continues to grow, we might sell or buy certain subsidiaries and/or business units. In such transactions, customer information is generally one of the transferred assets. Also, in the unlikely event that Muffingames, Inc., or substantially all of its assets, are acquired, customer information would in most cases be one of the transferred assets.

Protection of Muffingames, Inc. and Others:

Service, you may be automatically registered to receive one or more of our promotional e- newsletters. Note that when you provide an email address through a Muffingames, Inc. Service, we treat that as a request to be enrolled in one of our promotional e-newsletter lists, even if you previously opted out of receiving newsletters from us. If you change your mind and wish to opt out again, you may do so at any time by clicking the "unsubscribe" link at the bottom of any newsletter, and then following the instructions provided. If you express interest in a Muffingames, Inc. Service by clicking on a banner within a newsletter, you may be automatically registered to receive newsletters relating to the Muffingames, Inc. Service that appeared in the banner.

At any time, you may opt-out of receiving a newsletter by selecting the "unsubscribe" link at the bottom of any newsletter. We treat each Muffingames, Inc. Service individually, so if you are receiving mailings from more than one Muffingames, Inc. Service, and you want to unsubscribe, you must do so by selecting the “unsubscribe to all” link at the bottom of any newsletter. Services may allow you to play or share information through social media (such as by logging in through a social media account or using a "Like" button) or contain links to social media services or other third parties. The use of these features and links are subject to the privacy policies of those companies and your settings on those services. Muffingames, Inc. has no control over, and is not responsible for, the information submitted to or collected by social networks or other third parties. We encourage you to review those third-party privacy policies to understand the way your information may be collected and handled by such third parties.

CHAT & MESSAGING FEATURES

 

Muffingames, Inc. Services may operate message boards and/or chat areas where users can exchange ideas and communicate with each other. When partaking in such communication features, you acknowledge that the information is being made publicly available in an online environment. Any information posted is the sole responsibility of the individual user.

U.S. STATE PRIVACY NOTICE

For residents covered under the State Privacy Laws, this U.S. State Privacy Notice supplements the information contained in our Privacy Policy by providing additional information under such laws. The term “State Privacy Laws” means, as applicable, the California Consumer Privacy Act (the “CCPA”), the Colorado Privacy Act, the Connecticut Data Privacy Act, the Utah Consumer Privacy Act, and the Virginia Consumer Data Protection Act.

The Right to Access

Under the State Privacy Laws, you have the right to obtain confirmation regarding whether we are processing your personal information and to access that personal information. You also have the right to access that personal information in a portable, readily usable format, unless not technically feasible to provide in such a format.

Specifically with respect to the CCPA’s right to access, you have the right to request the following: (a) the specific pieces of personal information the business has collected about you and (b) the categories of personal information collected, the sources of collection, the business/commercial purpose for collecting or "selling/sharing" personal information, and the categories of third party to whom the business discloses personal information.

The Right to Deletion

You have the right to request the deletion of Personal Data we have collected from you, subject to certain exceptions under the State Privacy Laws.

The Right to Correction

You have the right to request that inaccuracies in your Personal Data be corrected, taking into account the nature of the personal information and the purposes of the processing of your personal information.

Opt-Out Rights

Under State Privacy Laws, you have the right to opt-out of “sales” and “shares” of personal information, “targeted advertising,” and certain use/disclosure of “sensitive” personal information.

As further described in this Privacy Policy, we disclose the following to our advertising/marketing and analytics partners (e.g., advertisers/agencies, social media networks, adtech partners) for advertising and marketing purposes, including direct marketing: Identifiers, commercial information, geolocation data, internet or other network information, and data that may be considered “sensitive” personal information under certain State Privacy Laws. Please see our “Your Privacy Choices” link (found in the website footer or relevant app settings) to exercise your opt-out rights accordingly.

We do not have actual knowledge of “selling” or “sharing” Personal Data of consumers under sixteen (16) years of age.

 

To Exercise Your Privacy Rights

To submit a request to exercise your right to access, deletion, or correction, please use this form.

To exercise your right to opt-out of “sales,” “shares,” “targeted advertising,” or certain use/disclosure of “sensitive” personal information, please click our Your Privacy Choices link (found in the website footer) and follow the instructions therein. As discussed in such link, you may also visit our website with the Global Privacy Control (GPC) signal enabled to opt-out of “sales/shares” via tracking technologies (learn more about GPC at www.globalprivacycontrol.org). This tracking technology-based opt-out is on a per-website basis and applies at the browser level for the device you use to opt out.

Unless otherwise prohibited by the State Privacy Laws, we may need to verify your identity and confirm your residency before processing your request. In order to verify your identity, we will generally either require the successful authentication of your account or the matching of sufficient information you provide us to the information we maintain about you in our systems. This process may require us to request additional personal information from you, including, but not limited to, your email address, phone number, or date of last transaction on our Service.

In certain circumstances, we may decline a request to exercise the rights described above, particularly where we are unable to verify your identity or locate your information in our systems. If we cannot comply with a request, we will explain the reasons in our response.

 

Non-Discrimination and Appeals

You have the right to not receive “discriminatory” treatment for exercising the rights discussed in the table above. However, please note that if the exercise of these rights limits our ability to process personal information (such as in the case of a deletion request), we may no longer be able to provide you our products and services or engage with you in the same manner.

Further, under Colorado, Connecticut, and Virginia’s State Privacy Laws, you may appeal our decision to not take action on your rights request. All appeals should be submitted by emailing contact@muffingames.io, along with a copy of the decision that you are appealing.

 

Authorized Agents

In certain circumstances under the State Privacy Laws, you are permitted to use an authorized agent to submit requests on your behalf (using the mechanisms for submitting requests above), where we can verify the authorized agent’s authority to act on your behalf.

For requests to access, delete, or correct personal information, we require the following for verification purposes:

·       a power of attorney from you or your authorized agent that is valid under the laws of the applicable state where you reside; or

·       sufficient evidence to show that you have:

o   provided the authorized agent signed permission to act on your behalf; and

o   verified your own identity directly with us or directly confirmed with us that you provided the authorized agent permission to submit the request on your behalf.

For requests to opt-out of “sales,” “shares,” or the processing of your personal information for “targeted advertising” under the State Privacy Laws, we require a signed permission demonstrating your authorized agent has been authorized by you to act on your behalf.

 

Deidentified Information

Where we process “deidentified information” (as such term is defined under the State Privacy Laws) and are required to keep such information deidentified, we commit to maintain and use the information in deidentified form and will not attempt to reidentify the information, except in instances where necessary for determining whether the deidentification process we used satisfies the requirements under applicable law.

The following additional disclosures apply to California residents.

·       Categories/Use of Personal Data: In the last 12 months, please see the list below for the categories of personal information we have collected. Further, please see “How Do We Use Personal Information?for the purposes for which such personal information is used.

Each price or service difference related to the collection and use of personal information is based upon our reasonable, good-faith determination of the estimated value of such information to our business, such as by calculating the expense related to the offer, provision, or imposition of the financial incentive or price or service difference or revenue generation or expense related to the sale, collection, or retention of consumers’ personal information.

CHILDREN

 

Muffingames, Inc. Services do not knowingly collect "personal information" as defined in the Children’s Online Privacy Protection Act ("COPPA") from children under 13, other than when permitted by COPPA, like for support of internal operations. If you are under 13, you may not register for an account or otherwise provide any personal information to us.

Muffingames, Inc. respects the privacy of parents and children and is committed to complying with COPPA. If a parent believes that his or her child has submitted personal information to Muffingames, Inc., he or she can contact us via email at contact@muffingames.io. We will take reasonable measure to promptly remove the information upon learning that it was inadvertently gathered from a child under the age of 13. We recognize the importance of safeguarding the privacy of children and encourage parents to check and monitor their children's use of online activities regularly.

 

 

GDPR

The General Data Protection Regulation (GDPR) introduces obligations that will impact companies around the world. This law offers a common framework across the European Union (EU) for organizations exposed to personally identifiable information (PII) relating to individuals located in the EU. The GDPR sets a new level and cost of accountability that all organizations - even those that don't do business in Europe - must pay attention to.

You, as a user, have the right to:

- Review your personal data
- Correct errors in your personal data
- Object to processing of your personal data
- Erase your personal data

You can erase your personal data any time. Please be advised that by deleting your personal data, all game progress, and virtual goods or currency paid for and/or earned across ALL Muffingames, Inc. games will be terminated. Copies of some material (example: log records) may remain in our database but are disassociated from personal identifiers.

Data Retention

We will not keep your Personal Data for longer than required. The precise duration for which we keep your Personal Data when you have a live member account with us or for a period after you cease to be a member with us, can vary and depends on various reasons. To determine the appropriate retention period for Personal Data, we consider the amount, nature and sensitivity of the Personal Data, the potential risk of harm from unauthorized use or disclosure of your Personal Data, the purposes for which we process your Personal Data and whether we can achieve those purposes through other means, and what the law requires us to do. For example, we retain a copy of your Member Account’s records of all financial and wagering transactions together with any identification provided for as long as is necessary for the relevant service and for no longer than 7 years after you have closed your Member Account.

When we no longer need to keep your Personal Data, we anonymize it securely and this process cannot be reversed. Additionally, where we decide to retain your information for analytics purposes, we will fully anonymize it in accordance with applicable security standards, so it can never be linked back to an individual.

Please note that if you decide to opt-out from receiving marketing communications from us, we will need to retain a copy of your contact details, so we can add them to our suppression list and make sure you do not receive any information about our future marketing activities.
